ARTICLE 1 – DEFINITIONS

In these Terms & Conditions, the following definitions apply:

  • Reflection Period: The period during which the consumer may exercise their right of withdrawal.
  • Consumer: A natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.
  • Duration Transaction: A distance contract relating to a series of products and/or services, where delivery and/or purchase obligations are spread over time.
  • Durable Data Carrier: Any tool enabling the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unaltered reproduction.
  • Right of Withdrawal: The consumer’s ability to cancel the distance contract within the reflection period.
  • Entrepreneur: The natural or legal person (Inter Spice Ltd.) offering products and/or services to consumers at a distance.
  • Distance Contract: An agreement concluded exclusively via one or more distance communication techniques (e.g., website, email) within a system organized by the entrepreneur.
  • Distance Communication Technology: Means used to conclude an agreement without the consumer and entrepreneur being physically present at the same time.
  • General Terms & Conditions: These present terms of the entrepreneur.

ARTICLE 3 – APPLICABILITY

  1. These Terms & Conditions apply to every offer by the entrepreneur and every distance contract or order between the entrepreneur and consumer.
  2. Before concluding the distance contract, the text of these Terms & Conditions will be made available to the consumer. If not reasonably possible, it will be indicated where they can be viewed and sent free of charge upon request.
  3. If concluded electronically, the Terms & Conditions will be provided in a downloadable and storable format (e.g., PDF) before conclusion.
  4. In case of conflicting provisions, the consumer may invoke the most favorable clause.
  5. If any provision is void or annulled, the remainder remains valid, and the invalid provision will be replaced with one closest to its original intent.
  6. Situations not covered shall be interpreted in the spirit of these Terms & Conditions.

ARTICLE 4 – THE OFFER

  1. Offers with limited validity or conditions will clearly state such terms.
  2. Offers are non-binding; the entrepreneur may modify or withdraw them.
  3. Offers include a complete and accurate description of products/services, sufficient for proper consumer assessment.
  4. Images are truthful representations; obvious errors do not bind the entrepreneur.
  5. Each offer clearly states:
    • Price (in CAD, excluding customs/import duties if applicable — borne by customer)
    • Free shipping within Canada
    • Method of contract conclusion
    • Applicability of right of withdrawal
    • Payment, delivery, and execution methods
    • Offer acceptance period or price guarantee duration
    • Whether the contract is archived and accessible post-conclusion
    • Consumer’s ability to check and correct data before concluding
    • Languages available (English/French)
    • Minimum contract duration (if applicable)
    • Available sizes, grind levels, or packaging options

ARTICLE 5 – THE AGREEMENT

  1. The agreement is concluded when the consumer accepts the offer and meets all conditions.
  2. Electronic acceptance is immediately confirmed via email. Until confirmation, the consumer may cancel.
  3. The entrepreneur ensures secure data transmission and a safe web environment.
  4. The entrepreneur may verify the consumer’s ability to fulfill payment obligations. Orders may be refused or subject to special conditions with justification.
  5. The following will be provided with the product/service (in writing or on a durable medium): a. Visiting address for complaints b. Conditions and method of right of withdrawal (or exclusion notice) c. Warranty and after-sales information d. Data from Article 4(5) e. Termination conditions for contracts >1 year
  6. Each contract is subject to sufficient product availability.

ARTICLE 6 – RIGHT OF WITHDRAWAL

  1. Consumers may cancel within 30 days of receipt (reflection period starts the day after delivery).
  2. During this period, handle products/packaging with care. Unpack only to assess (e.g., open jar to smell — do not use in cooking).
  3. To withdraw:
    • Notify via email (info@inter-spice.com) within 30 days
    • Return within 14 days of notification with proof of shipment
  4. If not notified or returned timely, the purchase is final.

ARTICLE 7 – COSTS IN CASE OF WITHDRAWAL

  1. Return shipping costs are borne by the consumer (except for defective/incorrect items).
  2. Refunds issued within 14 days of receiving return or proof of shipment.

ARTICLE 8 – EXCLUSION OF RIGHT OF WITHDRAWAL

The right of withdrawal is excluded for:

  1. Products made to consumer specifications (e.g., custom blends)
  2. Perishable goods (e.g., fresh spices, ground herbs)
  3. Sealed products broken for hygiene reasons (e.g., opened bulk bags)
  4. Products that spoil quickly

Exclusion is clearly stated in the offer before purchase.


ARTICLE 9 – THE PRICE

  1. Prices during the offer’s validity will not increase, except due to tax changes.
  2. Prices are in CAD, include applicable taxes (HST/GST/PST), and reflect free shipping.
  3. Price increases within 3 months post-contract: only if required by law.
  4. Price increases after 3 months: only if stipulated and due to legal changes; consumer may cancel from effective date.
  5. Printing/typesetting errors do not bind the entrepreneur.

ARTICLE 10 – CONFORMITY & WARRANTY

  1. Products comply with the agreement, offer specifications, and reasonable standards of quality/usability.
  2. Warranty matches manufacturer’s; entrepreneur is not liable for suitability beyond normal use.
  3. Report defects/wrong items within 14 days of delivery. Return in original packaging, unused.
  4. Warranty void if:
    • Consumer repairs/modifies product
    • Product exposed to abnormal conditions
    • Defect results from government regulations on materials

ARTICLE 11 – DELIVERY & EXECUTION

  1. Orders processed with utmost care.
  2. Delivery to the address provided by the consumer.
  3. Orders shipped within 1–2 business days; delivery in 5–7 business days.
  4. If delayed >14 days, consumer may cancel without cost and claim damages.
  5. Risk transfers upon delivery to consumer or designated representative.
  6. If unavailable, a replacement may be offered (withdrawable). Return costs borne by entrepreneur.

ARTICLE 12 – DURATION CONTRACTS

  1. Indefinite contracts: Terminable anytime with 1-month notice.
  2. Fixed-term contracts: Terminable at end of term with 1-month notice.
  3. Auto-renewal: Not allowed unless consumer can cancel with ≤1 month notice.
  4. Contracts >1 year: Terminable after 1 year with 1-month notice, unless unreasonable.

ARTICLE 13 – PAYMENT

  1. Payment due within 7 business days of reflection period start (or upon service agreement confirmation).
  2. Report payment data errors immediately.
  3. In case of default, reasonable pre-communicated costs may be charged (subject to law).

ARTICLE 14 – COMPLAINTS PROCEDURE

  1. Submit complaints within 7 days of discovering defects, fully described.
  2. Response within 14 days. If longer, acknowledgment with expected timeline.
  3. If unresolved amicably, dispute eligible for resolution.
  4. Complaints do not suspend obligations unless stated in writing.
  5. Valid complaints: free repair/replacement at entrepreneur’s discretion.

ARTICLE 15 – DISPUTES

Contracts are governed by the laws of British Columbia, Canada. Disputes fall under Canadian jurisdiction, even if the consumer resides abroad.


ARTICLE 16 – SMS MARKETING

By opting into SMS at checkout, purchase initiation, or via our tools, you consent to recurring SMS messages (order updates, abandoned cart reminders, promotions, review requests) — even if your number is on Canada’s National DNCL. Message frequency varies. Consent is not required to purchase.

To opt out:

  • Reply STOP to any message
  • Use the unsubscribe link in messages

Other methods (e.g., “unsubscribe” text) are invalid. We do not charge for SMS, but carrier message/data rates apply.
